We can assist with drafting contracts or negotiating the terms of a contract on your behalf if you do not have an agent involved or have any special terms you want included in your contract.

It is important that at the time you receive a draft contract, you seek legal advice immediately, so that you can negotiate the terms of the contract. If the contract is already signed before you provide it to you solicitor, it is often difficult to then negotiate the terms of the contract. If you provide us with the draft contract before you sign it, we can explain the contract terms to you in an easy to understand way to ensure you enter into a deal you are comfortable with and there are no nasty surprises that could have been easily avoided.

If you are buying a property we will assist you on all aspects of the conveyancing process including:

  • Explaining to you the contract and its terms and conditions
  • Explaining what risks you need to be aware of and how to protect yourself
  • Explaining what a ‘cooling off’ period is and your rights to use it
  • Advising you of the various timeframes that you have to meet under the contract
  • Ensuring you obtain the necessary property reports within the required time, such as building and pest reports
  • Conducting the necessary searches over the property as per your instructions and providing you with copies of the search results
  • Providing you with the necessary Declaration forms for Transfer Duty and attending to stamping of your Contract and Transfers with the Office of State Revenue
  • Explaining to you about the steps you need to take when applying for finance
  • Explaining what property searches are available and the benefits of each and conducting these on your behalf
  • Assisting you in satisfying the special conditions of the contract
  • Providing you with the necessary documents you need to sign
  • Liaising with your financier to book in settlement and ensure sufficient funds are available
  • Calculating settlement figures and making necessary adjustments
  • Attending settlement on your behalf
  • Notifying Council of the change of ownership so future rates notices issue to you

If you are selling a property we will assist you with the sale including:

  • Advising you of the terms and conditions of the contract
  • Notifying you of the timeframes the buyer has to meet and what your options are if those are not met
  • Assisting you with notifying any mortgagee of the sale
  • Receiving in confirmation from the Buyer’s solicitor on the satisfaction of the special conditions and notifying you
  • Providing you with documents you need to sign, e.g. transfer documents
  • Liaising with your mortgagee to book in settlement with them and ensuring sufficient funds are available
  • Calculating settlement figures and making necessary adjustments
  • Attending settlement on your behalf
  • Notifying Council of the change of ownership, so future rates notices issue to the buyer
  • Advising you of what needs to be done prior to and after settlement
